Human dignity—is it a useful concept in bioethics, one that sheds important light on the whole range of bioethical issues, from embryo research and assisted reproduction, to biomedical enhancement, to care of the disabled and the dying? Or is it, on the contrary, a useless concept—at best a vague substitute for other, more precise notions, at worst a mere slogan that camouflages unconvincing arguments and unarticulated biases?

Contains a collection of essays exploring human dignity and bioethics, a concept crucial to today's discourse in law and ethics in general and in bioethics in particular.

The emergence of macroscopic variables can be effected through coarse graining. Despite practical and fundamental benefits conveyed by this partitioning of state space, the apparently subjective nature of the selection of coarse grains has been considered problematic. We provide objective selection methods, deriving from the existence of relatively slow dynamical time scales. Using a framework for nonequilibrium statistical mechanics developed by us, we show the emergence of both spatial variables and order parameters. Although significant objective criteria are introduced in the (...) coarse graining, we do not provide a unique prescription. In most theories of the quantum measurement process changes in an observer’s perception of a state can take place without forces, as for example if a state is prepared in an eigenstate of \ but \ is measured. In the “special state” theory any change in wave function requires forces. This allows experimental tests to distinguish these ideas and in the present article two examples of such tests are considered. The “absorber theory” of Wheeler and Feynman is supposed to justify the use of retarded potentials in ordinary electromagnetic calculations despite a fundamentally time symmetric interaction. We restate the thesis of absorber theory as follows: here exist causal solutions of time symmetric electrodynamics. In our formulation, absorption need only take place in one direction of time (the future) rather than both, as seems to be required by Wheeler and Feynman. Even with complete absorption, however, the effects of advanced interactions are (...) not entirely eliminated and a residual field may introduce a degree of indeterminacy into particle trajectories obtained using retarded potentials alone. The arts of rule cover the exercise of power by princes and popular sovereigns, but they range beyond the domain of government itself, extending to civil associations, political parties, and religious institutions. Making full use of political philosophy from a range of backgrounds, this festschrift for Harvey Mansfield recognizes that although the arts of rule are comprehensive, the best government is a limited one.

This article is a critical response to Concepción, Messineo, Wieten, and Homan’s “The State of Teacher Training in Philosophy.” In it, I utilize an epistemologies-of-ignorance framework to highlight the incentives we, as philosophers, have to ignore teaching and learning about teaching and learning. I argue that the problems are not merely about our individual desires, but rather, that there is a regime of ignorance that encourages us not to know. I argue therefore that real change requires more than a shift (...) in personal commitments; it requires a change to the system, including how and what we make public and how we evaluate and are evaluated by our peers. Robert Grosseteste was a prolific theological and scientific writer, a translator, bishop of Lincoln , and a candidate for sainthood. There have been several studies of his life and his works, the most recent being that of Richard Southern. Nevertheless, James McEvoy's comment in 1983 that “the course of Grosseteste's life up until 1225 is almost completely unknown” remains largely true. The problem is common in medieval history—there is a dearth of reliable sources for the subject's early life. I do (...) not intend to discuss here Grosseteste's youth, or even his life until 1198 . I will accept, with a few reservations, the model Southern presented for Grosseteste's life until 1198 — that Grosseteste came from an undistinguished family, acquired an education, and may have taught in local schools; after serving the bishop of Lincoln in a minor capacity, he managed to obtain an administrative position under Bishop de Vere in the diocese of Hereford. Unfortunately, Bishop de Vere died on Christmas Day 1198, and his household was disbanded. It is the period following 1198 until 1225 that needs scrutiny. The recent discovery of a reference to Robert Grosseteste in a thirteenth-century cartulary demands that we reconsider the way in which historians have structured Grosseteste's career, both because of what this manuscript records and because of the light it sheds upon the methodology that has underpinned Grosseteste scholarship. A pair of harmonic oscillators come in contact and then separate. This could be a model of an atom encountering an electromagnetic field. We explore the coherence properties of the resulting state as a function of the sort of initial condition used. A surprising result is that if one imagines a large collection of these objects repeatedly coming in contact and separating, the asymptotic distribution functions are not Boltzmann distributions, but rather exponentials with the same rate of dropoff.

The Covid-19 pandemic raised questions about the viability of food chains and created new opportunities for small-scale producers. This study reports on findings from a project directed at investigating how niche meat farmers respond to external challenges and threats including those related to their position as small-scale producers and those that are pandemic-related. A purposeful sample (_N_ = 5) of local meat producers in NC, recruited through their producer network, were interviewed twice (in 2021 and again in 2022) via Zoom. (...) Informants were interviewed about the characteristics of their farm enterprises and households. The niche meat farmer informants in this study are diversified, values-based operations that utilize pasture-based production practices. They draw upon their farm enterprise and household assets, including the allocation of labor to farm, non-farm, and household activities, to meet economic production and social reproduction needs. Overall, our results show that the resiliency of the niche-meat producers flows from this integration of the farm enterprise and the household. While the data are based on a very limited sample, the results are consistent with literatures on women in agriculture and peasant economy. Therefore, we argue that future studies of how small-scale farms react to exogenous change, like the pandemic, include details on household composition and the gender division of labor for on-farm, off-farm, and social reproduction activities. This paper seeks to add a new facet to the definition (s) of fascism, that amorphous social, cultural, political, and aesthetic conception that has inspired no small degree of controversy over the years since the defeat of the Nazis—indeed, even since the ascension of Mussolini. I argue that the conception of “decadence” by ruling or vanguard party circles, and the expression of a need for such decadence to be purged for the health of the society, is a central tenet of (...) fascist or crypto-fascist ideology in either its rise to power or renewed consolidation of power. In this view, “fascim”, does not necessarily mean the Nazis, and “decadence” need not signify a circumscribed artistic definition, connoting a certain circle of late-nineteenth-century painters in poets, especially in France. Though I regard period-circumscribed views of fascism and decadence as informative, I hope to offer a new framework in which the two concepts, seen in perpetual, relation to each other, break historical bonds and tell us about deeper, transhistorical political trends. In doing so, we may be better equipped to guard against the renewed emergence of crypto-fascist ideology by taking this rhetoric of a “purgation of decadence,” wherever it comes from, as a serious warning. Thus I will use historical cases outside of the standard Hitler-Mussolini axis that I view to exhibit overtly fascist tendencies, such as Khmer Rouge Cambodia and Cultural Revolution Maoist China, and I will make normative claims about current ideological currents that, while certainly not neo-Nazi, may also contain fascist or crypto-fascist tendencies. This paper argues that too restrictive an understanding has governed both academic and popular analysis of the social, cultural, and political conflicts between the Western European majorities and their Islamic minorities. These conflicts are typically viewed through the prisms of majority racism and/or minority economic disadvantage. While such social facts are undoubtedly important, I argue that the ideology of radical Islamism must be taken seriously in any analysis of the problem. Thus, I do two things in this essay. I outline (...) the elements in twentieth-century radical Islamic writings that relate to the relationship between (broadly understood) Islamic and Western civilization; I also offer an overview of the now long-lived situation of culture war in Western Europe that supports my argument that Islamic cultural pathology, more than European racism, is the chief causal factor. This is intended as a warning that “clash of civilization” and “Islamo-fascism” models, usually disparaged in the academy, must be taken quite seriously. (shrink)

The quantum Zeno effect (QZE) is often associated with the ironic maxim, “a watched pot never boils”, although the notion of “watching” suggests a continuous activity at odds with the usual (pulsed measurement) presentation of the QZE. We show how continuous watching can provide the same halting of decay as the usual QZE, and, for incomplete hindrance, we provide a precise connection between the interval between projections and the response time of the continuous observer. Thus, watching closely, but not so (...) closely as to halt the “boiling”, is equivalent to—gives the same degree of partial hindrance as—pulsed measurements with a particular pulsing rate. Our demonstration is accomplished by treating the apparatus for the continuous watching as a fully quantum object. This in turn allows us a second perspective on the QZE, in which it is the modified level structure of the combined system/apparatus Hamiltonian that slows the decay. This and other considerations favor the characterization “dominated time evolution” for the QZE. (shrink)

In this paper, we offer a method of teaching argumentation that consists of students working through a series of cumulative, progressive steps at their own individual pace—a method inspired by martial arts pedagogy. We ground the pedagogy in two key concepts from the scholarship of teaching and learning: “deliberate practice” and “deep approaches to learning.” The step-by-step method, as well as the challenges it presents, is explained in detail. In a recently proposed quantum measurement theory the definiteness of quantum measurements is achieved by means of “special” states. The recovery of the usual quantum probabilities is related to the relative abundance of particular classes of “special” states. In the present article we consider two-state discrimination, and model the apparatus modes that could provide the “special” states. We find that there are structural features which, if generally present in apparatus, will provide universal recovery of standard probabilities. These structural features relate (...) to the distribution of certain Hamiltonian matrix elements or interaction times. In particular, those quantities must be asymptotically (x → ∞) distributed according to the Cauchy law, Ca(x)=a/π(x 2 +a 2 ). (shrink)

We show that in a dilute gas the wave function’s spreading is limited by scattering off other particles. This shows that quantum mechanics can be consistent with the kinetic theory of gases.

Psychologists and psychiatrists recently started using electronic mail (e-mail) to conduct therapy. This article explores relevant ethical and legal issues including, among others, the nature of the professional relationship, boundaries of competence, informed consent, treating minors, confidentiality, and the duty to warn and protect. To illustrate these complex issues, two services currently operating are discussed. To address potential hazards to clients and the profession, a new ethical standard for e-mail therapists is offered.

This collection of essays, commissioned by the President’s Council on Bioethics, explores a fundamental concept crucial to today’s discourse in law and ethics in general and in bioethics in particular. Since its formation in 2001, the council has frequently used the term “human dignity” in its discussions and reports. The "theory of mind" framework has been the fastest growing body of empirical research in contemporary psychology. It has given rise to a range of positions on what it takes to relate to others as intentional beings. This book brings together disparate strands of ToM research, lays out historical roots of the idea, and indicates better alternatives.

An overview on archaeological evidence, provided by Colagè and d’Errico, reveals that the timing, location, and pace of cultural innovations are more consistent with scenarios that take culture, rather than genetic evolutionary processes, as the key driving force for human cognition. The authors elaborate on those mechanisms by which cultural evolution operates, with a specific focus on cultural exaptation and cultural neural reuse.

En filosofía de la mente se ha sugerido que, a diferencia de los estados puramente materiales, los estados conscientes serían aquellos de los cuales podemos decir que existe ‘un algo que es como estar en ellos’ para un sujeto, esto es, estados que poseen una fenomenología. Asumiendo una demarcación intuitiva entre estados sensoriales y estados cognitivos, durante los últimos años se ha establecido un debate en torno a la pregunta acerca del carácter fenoménico de nuestros estados cognitivos, especialmente, el de (...) nuestros pensamientos. A este asunto se le ha denominado el debate acerca de la fenomenología cognitiva. El análisis del debate parece depender del examen crítico de las formas en las que establecemos conclusiones acerca de los componentes fenoménicos de nuestra propia vida mental. El presente artículo elabora diversos problemas que se derivan del uso de dos estrategias en este contexto: reportes introspectivos y los contrastes fenoménicos. Luego de analizar la forma en que tales estrategias podrían favorecer a cierta posición dentro del debate, el artículo concluye comentando cómo algunos asuntos asociados a la fenomenología de la actividad matemática podrían iluminar el debate. Is property-awareness constituted by representation or not? If it were, merely being aware of the qualities of physical objects would involve being in a representational state. This would have considerable implications for a prominent view of the nature of successful perceptual experiences. According to naïve realism, any such experience—or more specifically its character—is fundamentally a relation of awareness to concrete items in the environment. Naïve realists take their view to be a genuine alternative to representationalism, the view on which the (...) character of such experiences is constituted by representation. But naïve realists must admit qualities or property instances as items of awareness if they are to remain wedded to common sense, and the nature of property-awareness may smuggle constitutive representation into the naïve realist account of character. I argue that whether property-awareness involves representation, and consequently whether naïve realism is distinct from representationalism or not, depends on what qualities are fundamentally. On universalist and nominalist accounts, property-awareness turns out to involve representation. Not so under tropism. (shrink)

In philosophy, much attention has rightly been paid to the need to diversify teaching with regard to who teaches, who is taught, and which authors and questions are the focus of study. Less attention, however, has been paid to inclusive pedagogy—the teaching methods that are used, and how they can make or fail to make classes as accessible as possible to the diverse students who enter them. By drawing on experiences from our own teaching as well as research on student-centered, (...) inclusive best practices, we advocate for five principles of inclusive pedagogy: fostering a growth mindset, examining inclusive conceptions of authority, promoting transparency, encouraging flexibility, and, finally, continually promoting self-reflection for both students and teachers. Lackey’s (2007) class of “selfless assertions” is controversial in at least two respects: it allows propositions that express Moorean absurdity to be asserted warrantedly, and it challenges the orthodox view that the speaker’s belief is a necessary condition for warranted assertibility. With regard to the former point, I critically examine Lackey’s broadly Gricean treatment of Moorean absurdity and McKinnon’s (2015) epistemic approach. With regard to the latter point, I defend the received view by supporting the knowledge account, on which knowledge (...) is the necessary condition for warranted assertion. After examining two defenses of KA, by Montminy and Turri, I propose two alternative approaches. Although I remain neutral between them, I develop in more detail the view which classifies “selfless assertions” as “presentations”, a type of assertives distinct from genuine assertions. This account is motivated further by allowing for the expansion of the normative approach to other assertives, a feature we may be interested in, in the light of a recent wave of normative accounts of speech acts. Identifying, classifying, and analyzing arguments in legal discourse has been a prominent area of research since the inception of the argument mining field. However, there has been a major discrepancy between the way natural language processing (NLP) researchers model and annotate arguments in court decisions and the way legal experts understand and analyze legal argumentation. While computational approaches typically simplify arguments into generic premises and claims, arguments in legal research usually exhibit a rich typology that is important for gaining insights (...) into the particular case and applications of law in general. We address this problem and make several substantial contributions to move the field forward. First, we design a new annotation scheme for legal arguments in proceedings of the European Court of Human Rights (ECHR) that is deeply rooted in the theory and practice of legal argumentation research. Second, we compile and annotate a large corpus of 373 court decisions (2.3M tokens and 15k annotated argument spans). Finally, we train an argument mining model that outperforms state-of-the-art models in the legal NLP domain and provide a thorough expert-based evaluation. Naïve realists have a motive to but have thus far been unable to offer compelling reasons for positing an external constraint on the occurrence of the consciousness involved in perfect hallucinations. If the occurrences of such consciousness were confined to abnormal perceptual contexts, the possibility of perfect hallucinations would have no bearing on the nature of the consciousness involved in cases of perception. On the other hand, it is unclear why the character of the perceptual context should matter constitutively to (...) the occurrence of the sort of consciousness involved in perfect hallucinations. Supposing (reasonably) that such consciousness does not consist in an awareness of the environment, it is puzzling why the latter should be a certain way for the former to occur. I propose a solution to this puzzle, which helps secure the naïve realist approach to perception. Perfect hallucinatory experiences issue from exercises of the perceptual system operating in a second, defective mode – complementary to the normal one, whose exercises issue in an awareness of the environment. Critics denigrate the media for launching ethics discussions yet, there should be exploration of motives and recognition of efforts to overcome celebrated weaknesses and to develop climates in which values of information and humanism may be more comfortable with each other in media realms. Schulman has been press critic?columnist at the Louisville, Ky. Times and Courier?Journal.

Economic methodologists most often study the relations between models and reality while focusing on the issues of the model's epistemic relevance in terms of its relation to the ‘real world’ and representing the real world in a model. We complement the discussion by bringing the model's constructive mechanisms or self-implementing technologies in play. By this, we mean the elements of the economic model that are aimed at ‘implementing’ it by envisaging the ways to change the reality in order to bring (...) it more in line with the model. We are thus concerned mainly not with the ways to change the model to ‘fit’ the reality, but rather with the model's own armature that is supposed to transform the world along theoretical lines. The case we study is Arrow–Debreu–McKenzie general equilibrium model. In particular, we show the following: gradient methods and stability could be regarded as constructive mechanisms of general equilibrium modeling in the context of market socialism debates; the obsession of general eq.. Conversation analysts have noted that, in psychotherapy, formulations of the client's talk can be a vehicle for offering a psychological interpretation of the client's circumstances. But we notice that not all formulations in psychotherapy offer interpretations. We offer an analysis of formulations that are diagnostic: that is, used by the professional to sharpen, clarify or refine the client's account and make it better able to provide what the professional needs to know about the client's history and symptoms. In doing so, (...) these formulations also have the effect of shepherding the client's account towards subsequent therapeutic interpretation. In a coda, we notice that sometimes the formulations are designed discreetly. We examine one such discreet formulation in detail, and show how its very ambiguity can lead to its failure as a diagnostic probe. (shrink)

Two contributions from Dr Ivan Illich follow. The first, in which he sets out his primary thesis of the medicalization of life, is a section from Dr Illich's book `Medical Nemesis'. (It is reprinted with the permission of the author and his publishers, Messrs Calder and Boyars.) The second is a transcript of the paper which Dr Illich read at the conference organized by the London Medical Group on iatrogenic disease. Both are ultimately addressed to the recipients of medical (...) care, the general public, although the second paper is specifically addressed to young doctors and medical students. For Dr Illich the world is suffering from too much medical interference, and a medical edifice has been built which is one of the threats to the real life of human beings - a threat which so far has been disguised as care. This collection of essays represents an interdisciplinary approach to some contemporary issues in the philosophy of science and the theory of knowledge. It is also an attempt to place art in the context of human cognition in general and also to relate it to science and philosophy. Its conception is such that it accords with the view that our creativity is not separable from a humanistic orientation. Within such a humanistic framework, aiming at a stable form of peace becomes the (...) moral responsibility of both the scientist and the philosopher. (shrink)

The main focus of acquaintance theorists has been the nature and mechanism of perceptual acquaintance with particulars. Generally, one’s view of perceptual acquaintance with general features has taken its bearings from one’s view of perceptual acquaintance with particulars. This has led to the glossing over of significant differences in the mechanisms of perceptual acquaintance with particulars and with general features. The difference in mechanisms suggests a difference in the sort of epistemic state at play in the two kinds of cases. (...) While the existence of such a difference might initially seem to spell trouble for acquaintance theorists, it can be made palatable by being traced back to the distinct basic functions concepts of particulars and of general features serve in thought.
